WHAT IS
Delaware's
Birth Mandate?

DELAWARE'S BIRTH MANDATE.

Delaware is a 'birth mandate state,' which means children who are deaf, hard of hearing, deaf-blind, blind, visually impaired, and/or autistic, are eligible to receive education services upon identification.

 

An Act Concerning the Education of Children who are Deaf and Hard of Hearing 

As written the law ensures that

your school or any governing agency

provide your child with a “free

appropriate public education” that

includes “...special education and related

services designed to meet [the child’s]

unique needs and prepare them for

further education, employment and

independent living...”

The Individualized Family Service Plan — the “IFSP” — is the heart of early intervention. A written plan, called an IFSP, is developed by a team to record the family’s outcomes for themselves and their child. 

(also know as Part C and birth to 3)

504 Plan 

An Individualized Education Program is a process that outlines the learning goals for a student with disabilities and the services a school must provide the student in order to meet those goals.  This process is recorded in written form on the IEP document.

(also known as Part B)

A 504 plan is covered under Section 504 of the Rehabilitation Act, which is a federal civil rights law that ensures an individual cannot be discriminated against due to their disability. The 504 Plan ensures that a child who has a disability identified under the law and is attending an elementary or secondary educational institution receives accommodations that will ensure their academic success and access to the learning environment.
